Is there a category for mocked up screenshots? Should there be? I have uploaded two such files and they are currently uncategorised. Putting them in Category:Screenshots seems slightly misleading. Yaris678 (talk) 11:03, 10 May 2012 (UTC)

[edit] Should old magazines be uploaded as color or black and white?

I have photographed pages from a now-public-domain magazine. It is on glossy paper and appears to have been originally black ink on white or almost-white paper, but now the paper has turned slightly brown. Should I be editing the images to pure black and white, or retain the slight sepia tone to the paper? Downtowngal (talk) 04:08, 12 May 2012 (UTC)

Since this patina is real and impossible to recreate, I would say upload the original sepia-toned version. Then you could also upload the cleaned-up B&W versions, with the appropriate links to the original files. Best, mr.choppers (talk)-en- 07:34, 12 May 2012 (UTC)
I'd say it's your choice. If they're text and the B&W is as clear as the sepia, I'd not upload color versions. They take up more space, and we need a few illustrations of the fact that aged paper turns brown, not magazine after magazine of them. (If you can get clear, real black and white, not greyscale, versions of text, IMO, all the better.) If they're pictures, having as close a digital copy as we can might be nice for those graphics people who might be able to pull more out of color images then once graphical editing has been done on them.--Prosfilaes (talk) 19:11, 15 May 2012 (UTC)

Do illustrations created for Commons need to be supported by verifiable sourcing?

Take File:Loch Ness monster views.svg for example. The description says "Loch Ness monster sightings: 1) single hump, 2) many humps, 3) head and neck, 4) head and back, 5) head, neck and many humps.".

Who says so? The artist/creator? Or is Commons saying this?

I would think it is the artist's interpretation of reported monster sightings. If you think it is inappropriate on a specific article or page that it is used on, you could bring up a discussion there. I don't think it is necessary out of scope here. Killiondude (talk) 05:37, 13 May 2012 (UTC)

The website Cameraslens.com is a fan-run for the fatal frame series and has no official ties with Tecmo inc. I have a problem on the image I sent, and states: This media file does not have sufficient information on its copyright status. Unless the copyright status is provided, the file will be deleted seven days after this template was added: (13 May 2012). The cameraslens site has the banner for creative commons and I am also a member on the cameras lens forums, is there going to be a problem on the copyright status on the image and also I attached the file to the article I created on wikipedia Zero: Shinku No Chou an upcoming fatal frame game.

There are many different Creative Commons licenses, and only some of them are free. Wikimedia Commons only accepts content published under a free license. The Creative Commons license used on http://www.cameraslens.com/fatalframewiki/ is not free because it prohibits commercial uses and derivative works. Furthermore, neither you nor Cameraslens.com can issue any kind of license to works created by Tecmo. Only the legitimate copyright holder can issue a valid copyright license. Yes. There are some software with non-commercial versions, with EULAs restricting commercial usage of the software, but Paint.NET is not one of them, its EULA is quite permissive -- "Paint.NET is free for use in any environment, including but not necessarily limited to: personal, academic, commercial, government, business, non-profit, and for-profit."
Of course, it's better (and more in line with the spirit of Commons, free media repository) to use open-source software, such as Pinta (open-source Paint.NET fork), GIMP, MyPaint, or Krita, and forget about all these scary EULAs. --Trycatch (talk) 21:48, 13 May 2012 (UTC)
But pictures like File:Strange hypnotic face.jpg can't be uploaded to Commons, because there are nothing educational in them. Commons accepts only educational content, any self-made artwork without educational purpose will be deleted, see COM:SCOPE. --Trycatch (talk) 22:20, 13 May 2012 (UTC)
The software license agreement has no impact on content created using the software. Content created using completely proprietary software can be released into the public domain or published under a free license, and content created using free software is not automatically covered by a free license. [edit] Help with official German intwerwar photo copyrights

Background: I'm working on a # of en: articles about political figures in 1918-1938 Germany via translation requests from de:. Naturally photos are desired on new bios, and this period straddles the key 1923 US public domain date so gets confusing. My goal with this request is to get an expert answer then have it implemented on the Commons and en: for consistency. I am also a frequent commons user but very infrequent commons contributor, so apologies in advance if my question seems naive or was already answered.

Problem: To clarify I'll limit the problem to a set of 1938 en:Gauleiter photos, but there are various other known sets. All 1938 photos are on the German wiki and many, but not all, are already on the Commons. Either these are OK, and the rest can be transferred here, or they are inappropriate here and need removal. This is not to find fault as the issue is complicated. To further clarify, these are not Bundesarchiv photos. The source is Der Großdeutsche Reichstag 1938 IV. Wahlperiode, R. v. Decker´s Verlag Berlin 1938, a gov't publisher and the photos have no author. Files for comparison are: [1] on the commons, and one from the same set on German wiki [2] not on the commons.

Details: German Copyright Law 1 January 1966 declares that copyrights on publications by a legal entity expire under public law 70 years after the date of publication when the author is not named, as in this case (§ 134 sentence 2). That means the 1938 copyright expired 2008 and is of course OK on German wiki. However, the PD templates for US state that EU material that was NOT public domain in 1996 is NOT public domain in the US, having had their copyright period re-imposed by the URAA, implying anything after 1923 is not public domain.

Question: 1923 is easy. But for 1938, because these are official photos, does the German public entity law of 1966 apply or does the 1996 URAA date apply. For other sets, such as the 1928 Reichstag, the time consideration is similar minus 10 years. OR! maybe I'm not reading commons policy right: 1938 photos ARE OK here, but not for unlicensed re-use OUTSIDE of Europe. But then (this is my naive part), are such photos usable on the :en: Wiki. Currently there are many such articles using photos from this exact 1938 set, so this will have an impact once answered.

What is the policy on screenshots from films that are in copyright? I want to upload pictures of locations in London taken from old films (together with current pictures taken from the same angle). Screenshots from non-free copyrighted films must not be uploaded to Commons, and Commons does not accept fair use content. See Commons:Screenshots and Commons:Fair use. en:Wikipedia:Non-free content#Images is a page on the English Wikipedia project. I have photos taken of my son who is a Canadian actor and the photographer provides authorization to him or anyone representing him to use the photos for promotional purposes for an unlimited period of time. No you can't. The photos must be available for use by anyone for any purpose. For example, they must be usable by a person who is not representing your son, and they must be usable for purposes other than promotional. -- Asclepias (talk) 15:58, 14 May 2012 (UTC)

The file SirGeorgeEtherege.jpg, purportedly of Sir George Etherege, looks misattributed; it looks identical, except for being black-and-white, to the painting of William Congreve, by Godfrey Kneller, at William Congreve.jpg. I put my concerns on the talk page, but I'm afraid they'll be missed. I'd like to see a warning banner on the page, but I don't know if it's appropriate for me to add one, or if so, what one to use. I uploaded some flickr images, but unfortunately the license has been changed, for example, File:Kenji Williams at Fortune Brainstorm Green 2012.jpg(CC-BY > CC-BY-NC-ND), File:L'arc En Ciel @ MSG - 3-25-12 - 040.jpg(CC-BY-SA > All rights reserved). especially the old version(CC-BY-SA) of File:L'arc En Ciel @ MSG - 3-25-12 - 040.jpg was deleted from flickr, then new version(http://www.flickr.com/photos/gungirlnewyork/7200138608/in/photostream, All rights reserved) is uploaded there. That's no problem. The original licence is still valid but no longer indicated on Flickr. As long as the licence has been reviewed by someone, the licence can be assumed to be valid. --Stefan4 (talk) 14:27, 15 May 2012 (UTC)

I am considering using some images found on the Commons for a book cover. All images are PD worldwide. In order to use these images will I have to pay a license fee to the copyright owner, if there is one?

See:Commons:Reusing content outside Wikimedia. I think PD images don't have any copyright holder that you need to pay. Each image should have information on its image page. Some may just wish attribtion.--Canoe1967 (talk) 15:13, 15 May 2012 (UTC)

A photographer took a photo of me that I would like to make public domain in wikimedia commons. As you can see of his mail below, he says I can do whatever I want with the photos (but obviously, he does not want to be bothered to fill out any forms).

Can I upload it under "Entirely my own work".

Erst einmal würde ich in der Beschreibung ergänzen, um welches Gymnasium es sich handelt (Ort). Wenn es ein Deutsches Logo ist, erreicht es u.U. nicht die nötige Schöpfungshöhe. Wenn das Gymnasium nicht wichtig ist, fällt die Datei u.U. aus dem Projektrahmen. Wenn Du dennoch eine Freigabe senden möchtest, reicht es denke ich, wenn die Freigabe-E-Mail von einer offiziellen Schulemailadresse gesendet wird (die Schule wird doch hoffentlich eine eigene Domain registriert haben?) This File, I believe, when I put it in was labeled Century 21 Lake Realty Lawsuite, now it looks to have changed to Century 21 Lake Realty, is there a way it can be changed back? -unsigned

[edit] Thumbnail not updating

The thumbnail for File:Apollo 9 Schweickart EVA with camera.JPG has not updated since I uploaded a hi-res version of the file last night. I found this and all the others online through google, and they dont seem to have a copyright on them, or its probably a copy right where anyone can use it. If you could fix this for all the pictures i uploaded that would be great!

I created the file File:Naga montage.jpg using ten (10) files from Wikimedia Commons. I used the new Upload Wizard, which I am not familar with on uploading derivative of files from Wikimedia Commons. The file was already uploaded and I couldn't find the correct license option or if I missed it. Could you please help me in licensing this new file or Which copyright tag should I use for files from multiple files?

The ten files I used for these montage are:

There are four problems here:
  1. When you make a montage of several photos, you need to list all of them on the file information page. I've now listed the images you mentioned.
  2. You need to list a copyright tag. Based on the images you've used, it seems that the correct tag is {{cc-by-sa-3.0}}.
  3. You need to include a list of all photographers.
  4. Many of the photos show buildings in the Philippines. Unfortunately, the Philippines lacks freedom of panorama. This means that you need to identify the architect(s) of each building. Unless all architects died before 1962, the image violates the copyright of one or more architect. If that is the case, you need explicit permission from the architect, or else the photo will have to be deleted. --Stefan4 (talk) 00:06, 18 May 2012 (UTC)

Hi, I made high-resolution (and more nicely colored) images for these two images:

Unfortunately I couldn't figure out how to update/merge these pictures so that the high-res ones will show up in all related articles. Should I change all these articles manually or can someone here replace the old versions with the high-res ones in one keystroke?

One thing is, from the description you wrote, it seems that your images are from the film, not from the trailer. (Or if they are from the trailer, you didn't make that clear in the description). So, you may have a problem with the copyright (unless you source your statement that the film was issued without a copyright notice). Another thing is the pairs of images that you label "old" and "new" are not the same images. There should not be an automatic replacement, as any decision to replace or not to replace is an editorial decision to be taken on each project for each usage. -- Asclepias (talk) 16:13, 18 May 2012 (UTC)
I assumed that the copyright notice on the original screenshots ("Dr. Strangelove trailer from 40th Anniversary Special Edition DVD, 2004") meant that the film itself was issued without copyright notice. Otherwise how could a trailer from 2004 fall into that "published between 1923 and 1977" category? So I copied all the information from the original screenshot. Ah, I think I understand what you say about the "trailer from DVD" description by the uloader, and how that description can sound ambiguous. You assumed that it was a new 2004 trailer made specially for the DVD from parts of the film that were not used in the original 1964 trailer? I had not thought of that interpretation. Me, I assumed that it meant simply that the uploader made his screenshots from the 2004 DVD, but that the trailer on the 2004 DVD was itself essentially a copy of the original 1964 trailer. Hence the "published 1923-1977" tag about the trailer. The situation of a trailer published without a copyright notice, but (the rest of) the film published with a copyright notice. If the whole film was also in the public domain, we would probably have dozens of screenshots from it on Commons. I don't know where one can find the information about the copyright notices of movies, but someone else will probably be able to answer. About the replacement of images in articles on Wikipedia, my point was only to say that any choice between valid images is individual and depends on the judgment of the contributors to those Wikipedia articles, based on whatever criteria they want to use. Contributors to an article can have all sorts of reasons to prefer one image or another. It is not something that can be decided on Commons or "in one keystroke". I can only say that, in conformity with the general Wikimedia principle, if you, as a Wikipedia contributor, believe in good faith that a modification to an article will be beneficial and not controversial, you can do the modification. I just checked the movie, it says "Copyright (c) MCMLXIII Hawk Films Ltd. All Rights Reserved" right at the beginning. So do I understand you correctly that if I were to find a trailer from 1964 without notice on one of the blurays I could upload screenshots from it instead? However this might be in a different ratio than the movie and probably not in HD. How about fair use, I read that Wikipedias accept that too? Would that work in this case? Yes, you understand correctly, and I suppose that's probably why the images from the trailer were uploaded to the Commons (category:Dr. Strangelove). About fair use on Wikipedia, you'll have to see that with Wikipedia (en:WP:NFCC), but I don't think they would accept non-free high-resolution images, even less if free images are available from the trailer. -- Asclepias (talk) 02:45, 19 May 2012 (UTC)

You can add the Template:Speedydelete in the description page of each file. In the parameter of the template, explain the reason for requesting the deletion. With some luck, the deleting sysop will enter the reason in the logs as a deletion requested by the uploader instead of a deletion for copyright violation. -- Asclepias (talk) 14:55, 19 May 2012 (UTC)

There may be a few ways to do that. You could ask the uploader to request speedy delete of their file. You could upload yours to replace the older one and see if it gets reverted. In that case you would need to discuss the merits of keeping both files either on the talk pages, or a deletion request discussion. The simplest may be to upload yours to replace the existing.   • May I just say that is the most annoying thing I have perhaps ever seen on any WMF project. I don't know about anyone else, but when something is scrolling rapidly on the screen it draws my eye and makes it very hard to read anything else. I literally had to go into editing mode to be able to read your remarks. Thank you for the feedback, I will incorporate that into future designs, this one is already used by half a dozen people, but would slowing it down assist at all, or slightly different colours, I would try to help people on both sides if I can manage it. Penyulap

I don't think so. Most modern images on the net are copyrighted. You would have to have the photographer email permission or upload the image themselves.

I understand you all have a bit more complicated copyright scheme than Wikisource and I'm kind of wary of breaking anything so I figure I should just ask here. The electronic edition File:Spanish Constitution.djvu that is up here is several different varieties of terrible. I'd like to replace it with an electronic edition published by the Boletín Oficial del Estado, found here (PDF). The current one has an unusual license tag based on release statements on the website of the office of the PM. Spanish copyright law makes official documents and translations copyright ineligble (see article 13). You guys don't have a {{PD-SpanishGov}}. So I guess what I'm asking is could someone who knows what they're doing check if this works for Commons and if so make a {{PD-SpanishGov}}? Deeply obliged. Prosody (talk) 23:51, 19 May 2012 (UTC)

I think you have decided to finish the discussion. So I created a new one. You know, Fry again started the war of edits (this file: http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia.svg). He keeps his version of the file despite the fact that another version correctly (as I said it right on the blue (from the site of the Government Code).) On the talk page obschatsya he does not want. User Canoe1967 tried to reason with him, but Fry uploaded the correct version of the file to a file (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia-edit.svg). I think that we should change places files: upload the correct file in (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia.svg), and upload the doesnt correct file in (http://commons.wikimedia.org/wiki/File:Flag-map_of_Russia-edit.svg). She does seem to be a difficult editor to deal with and has asked admin to block me for edit warring on the file. You may wish to comment on that page. I agree that your map matches the actual colour of the flag but she has her file protected now. I mentioned above that I started a discussion on the talk page of one of the user box templates that uses it. If you reach consensus there you should be able to have your version used. Well, I am not exactly new here, but I just uploaded the linked photo, and after I had uploaded it, I got some doubts whether it was acceptable to license as I have done (CC-BY-SA). Some facts about the photo

  • The photo is taken in Denmark
  • It is a sign which is meant as a joke on a well-known historical building from 1788, which has been the home of a dean. However, prior to that, there was a small bakery at the location of the present building.
  • The golden sign (kringle), not the text part was stolen in 2009 and replaced by a new one crafted by a local builder of boats with assistence from people from Norway, also in 2009.
  • The humorous text originates from the Danish author Peter Seeberg who died in 1999. He was a museum custodian for the town museum as well. It is a rhyme in Danish and translates (approximately to) "The baker is unfortunately dead - so now he is not baking bread", which reflects on the prior location of a bakery there.

I am concerned that the text itself passes a threshold of originality, which makes it copyrighted, but I am not well-versed in this field. If there is any doubt that the license is not OK, feel free to open a DR (or I can do it). Thanks in advance, --Slaunger (talk) 22:13, 20 May 2012 (UTC)

No idea if the text is copyrightable or not, but I see that the sign follows the spelling reform of 1948, so I take it that this is a post-1922 sign. Thus, it may also be necessary to determine if it is copyrightable in the United States or not. --Stefan4 (talk) 15:40, 21 May 2012 (UTC)

  • I can't tell what the image is, and "Add caption here" is hardly an informative caption. It looks to me like it might be a contemporary work of art, and therefore presumably copyrighted. Я данные фото скачал с интернета из статей по аналогичной тематике, лицензии, конечно там не было. Через 7 дней фото будет удалено. Что мне делать в этой ситуации? Здравствуйте! Написал 5 статей о писателях Бурятии. Не было их фото. Нашел в интернете, причем на одном только сайте, вот ссылка : http://ayaganga.ru/bardsepic.htm . Взял фото оттуда. Никаких лицензии там , конечно, не было. При загрузке этих фото я написал, что файлы несвободны, что авторы неизвестны. Полагаю, что авторов самих давно нет, учитывая то, что и писатели, которых они фотографировали и рисовали, сами умерли также давно.
